1. Acceptance of Terms

By accessing or using CaptureFlow.io ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

CaptureFlow is a SaaS platform for event photo sharing. The Service allows event organizers to create photo galleries where guests can upload and view photos by scanning a QR code. Key features include:

• Event photo galleries with QR code access
• Guest photo uploads to shared galleries
• Free trial with limited photo uploads
• Premium upgrade for full features ($29.99 one-time payment)
• Downloadable photo collections

3. User Accounts

To use certain features of the Service, you must provide a valid email address. Account access is managed through:

• Email-based authentication with one-time login codes
• Dashboard access tokens for event management
• You are responsible for maintaining the security of your email account
• You must provide accurate and current information

4. Payment Terms

Premium features are available through a one-time payment processed via Stripe:

• Premium unlock fee: $29.99 per event (one-time, non-recurring)
• Includes 30-day upload window from event date and 1-year photo hosting
• All payments are processed securely through Stripe
• No Refunds: Due to the digital nature of the Service, all purchases are final. We do not offer refunds once premium features have been unlocked.
• Prices are subject to change with notice

5. User Content

You retain full ownership of all photos and content you upload to the Service ("User Content"). By uploading content, you grant CaptureFlow:

• A non-exclusive, limited license to host, store, display, and distribute your User Content solely for the purpose of operating the Service
• The right to create thumbnails and optimized versions for display purposes

What we will NOT do with your content:

• We will never sell, license, or share your photos with third parties
• We will never use your photos for marketing, advertising, or promotional purposes
• We will never train AI models or algorithms on your photos
• Your photos are displayed only within your private event gallery

You represent that you have the right to upload any content you submit and are responsible for ensuring you have permission to share photos of others.

6. Prohibited Uses

You agree not to use the Service to:

• Upload illegal, obscene, defamatory, or harmful content
• Share content that infringes on intellectual property rights
• Distribute spam, malware, or malicious code
• Abuse, harass, or harm other users
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service for any unlawful purpose
• Interfere with or disrupt the Service's operation

7. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. CaptureFlow does not guarantee:

• Uninterrupted or error-free service availability
• That the Service will meet your specific requirements
• The security or integrity of stored data beyond reasonable measures
• Preservation of uploaded content indefinitely

To the maximum extent permitted by law, CaptureFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

8. Data Retention & Deletion

CaptureFlow retains your data according to the following schedule:

• Free trial events: Photos and event data are automatically deleted 30 days after trial expiration or last activity
• Premium events: Retained for 1 year from the event date. We will send a reminder email before deletion
• On request: You may delete your events at any time through your dashboard. Deletion is processed within 7 days
• Account deletion: Request via email. All data permanently removed within 30 days

Warning: Free trial photos will be permanently deleted after 30 days. Upgrade to Premium to preserve your photos for 1 year.

9. Termination

CaptureFlow reserves the right to:

• Suspend or terminate accounts that violate these Terms
• Delete events and associated content for Terms violations
• Remove inactive events after extended periods of inactivity
• Discontinue the Service with reasonable notice

You may delete your events at any time through your dashboard. Upon termination, your right to use the Service ceases immediately.

10. DMCA & Copyright Infringement

CaptureFlow respects intellectual property rights. If you believe content on our Service infringes your copyright:

• Send a DMCA takedown notice to hello@captureflow.io
• Include: description of copyrighted work, location of infringing content, your contact information, and a statement of good faith belief
• We will respond to valid DMCA notices within 48 hours

11. Content Reporting

To report illegal, abusive, or inappropriate content:

• Email hello@captureflow.io with the event URL and description of the issue
• We review all reports within 24-48 hours
• Content violating our Terms or the law will be removed immediately
• We cooperate with law enforcement when required

12. Changes to Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas.
